Zero Tolerance Means Enforcement. We are aware that bail reform and statutory loopholes allow criminals and sex offenders out of jail after a short period of incarceration. That doesn’t mean we don’t hold up our end of the bargain; we still make the arrest.
Regarding the release of sex offenders who are out of compliance:
I directed the Lyon County Sheriff’s Office to take a zero-tolerance approach to violations of Nevada’s sex offender registration laws. Nevada law places clear responsibilities on registered sex offenders. It also places responsibilities on law enforcement. NRS 179D.550 states that when a local law enforcement agency becomes aware that an offender or sex offender has failed to comply with the requirements of Chapter 179D, the agency must take appropriate action to ensure compliance.
As Sheriff, I have made the decision that when our deputies establish probable cause that a registered sex offender has committed a criminal violation of Chapter 179D, the appropriate enforcement action is arrest and booking into the Lyon County Jail.
Our job is to enforce the law.
What happens after that arrest is a separate part of the criminal justice process.
There are currently issues within Nevada’s sex offender registration laws that can make prosecuting certain violations more difficult. We have identified those issues, and we are working to address them through the legislative process.
But those issues do not change our responsibility as law enforcement. We will not choose not to enforce the law because a statutory loophole may make prosecution more difficult. When our deputies establish probable cause that a violation has occurred, we will take enforcement action consistent with the zero-tolerance policy I established.
Registered sex offenders have a responsibility to know the requirements placed upon them and to remain in compliance with Nevada law. The Lyon County Sheriff’s Office will continue conducting compliance checks, investigating suspected violations, and taking enforcement action when violations are identified.
The roles in our criminal justice system are different.
** The Sheriff’s Office investigates and enforces the law.
** The District Attorney determines whether and how a case is prosecuted.
** The courts determine the outcome.
As Sheriff, my responsibility is to make sure the Lyon County Sheriff’s Office does its job.
That responsibility is clear. We will enforce the law. We will protect our communities. And when there is probable cause that a criminal violation has occurred, we will take appropriate enforcement action.
